    • 1.2 Hive is committed to protecting the personal information of all its website users, clients and customers (Users, you, and your) in accordance with the Privacy Act 2020 (Privacy Act) and the Information Privacy Principles as set out in the Privacy Act.
    • 1.3 Hive operates the website at hive.co.nz (the Website), which provides information regarding our services (Services).
    • 1.4 This privacy policy (Privacy Policy) operates to inform Users of our policies for the collection, use and disclosure of personal information (which includes, but is not limited to, your name, phone number and postal address) (Personal Information) if anyone accesses our Website and/or decides to use our Services.
    • 1.5 If you access our Website and/or decide to use our Services, then you agree to the collection, use, disclosure, storage and processing of your Personal Information in accordance with this Privacy Policy.

      (d) Other bodies, such as government agencies (including the Financial Markets Authority), regulators, and legal and professional advisers (whether or not we are legally obliged to disclose the Personal Information).
      (e) Any other person or entity where it is relevant to do so for the purposes set out above.
    • 5.2 Your Personal Information may also be used by, and you consent to the use of your Personal Information by, Hive (including any third party that provides services to Hive) to keep you informed about other financial opportunities, products and services, including by phone call, email, text message, Hive’s online portal or any other electronic means. Any electronic marketing communication offering other financial opportunities, products or services will include an unsubscribe facility.

    • 6.1 We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. However, no method of transmission over the internet, or method of electronic storage, is 100% secure and reliable, and we cannot guarantee its absolute security.

    • 8.1 Our Website and Services do not address anyone under the age of 13.

      (g) To request a transfer of your Personal Information to you or a third party.
      (h) To withdraw consent to the use of your Personal Information.

Please note that we may need evidence to confirm that you are the individual to whom the Personal Information relates. Your email should provide evidence of who you are and set out the details of your request. Hive will process this request as soon as reasonably practicable, provided that we are not otherwise prevented from doing so for legal or other reasons such as, but not limited to:
    • (a) providing such information would have an unreasonable impact on the privacy or affairs of other individuals;
      (b) providing such information is not reasonably practicable in the manner the User has requested; or
      (c) we have agreed with the User to arrange access to the Personal Information.

    • 11.1 Hive at all times has a person appointed as its privacy officer (the Privacy Officer).
    • 11.2 The Privacy Officer will be familiar with the provisions of this Privacy Policy and be available to assist on privacy matters for Hive.

    • 12.1 If you wish to make a complaint about a breach of this Privacy Policy or the Privacy Principles, you can contact us on the Contact Details below. You will need to provide us with sufficient details regarding your complaint together with any supporting evidence.
    • 12.2 We will refer your complaint to our Compliance Team who will investigate the issue and determine the steps (if any) that we will undertake to resolve your complaint. We will contact you if we require any additional information from you and will notify you in writing of the outcome of the investigation. We will aim to respond to and notify you of the outcome of our investigation regarding the privacy complaint within 20 business days of receiving the complaint.
    • 12.3 If you are not satisfied with the outcome, you can further contact us to discuss your concerns or make a complaint to the New Zealand Privacy Office via www.privacy.org.nz.
  • Severability

    • 13.1 If any part of this Privacy Policy is found by a court to be invalid, void or unenforceable, whether under the Privacy Act, GDPR or any other applicable law, such provision will be deemed to be deleted from this Privacy Policy and the remaining provisions will continue in full force and effect.
