1. Introduction

1.1 In this Privacy Policy, Hive, we, us and our means: (a) Hive Group Holdings Limited; and (b) its subsidiary companies Hive Funds Limited and Hive Investment Services Limited.

1.2 Hive: operates the website at hive.co.nz (the Website), which provides information regarding our services (Services); operates the desktop portal available via the Website and the mobile app portal called Hive Portal (both the Portal); and provides the Services.

1.3 Hive’s head office is located at 22 Dundonald Terrace, Mt Eden, Auckland. You can find our contact details on our Website.

1.4 Hive is committed to protecting the personal information of all its Website, Portal and Service users (Users, you, and your) in accordance with the Privacy Act 2020 (Privacy Act).

1.5 This privacy policy (Privacy Policy) operates to inform Users of our policy for the collection, use and disclosure of Personal Information as defined in the Privacy Act.

2. Information collection and use

2.1 We may collect the following types of Personal Information:

  • contact details such as name, email, residential address, phone number
  • identity verification information like date of birth, gender, passport, driver licence, proof of address, your voice or image
  • biometrics such as facial recognition data or voiceprint
  • employment and financial information including bank account details, income, investment expectations, investment choices, investment style, investment goals, employment status, employer
  • tax details including Inland Revenue number, prescribed investor rate, resident withholding tax rate and also international tax number and tax status where applicable
  • Website data such as your IP address, pages visited, browsing activity, Log Data (see 3 below) and Cookies (see 4 below)
  • Personal Information we reasonably require for us to provide you Services; and
  • Personal Information you choose to provide us.

2.2 The provision of certain Personal Information is necessary to provide our Portal and Services. While providing your information is voluntary, if you choose not to provide it, we may be unable to process your request or provide our Portal and Services.

2.3 While we will endeavour to collect your Personal Information directly from you, in some circumstances we may collect your information from:

  • people or organisations acting on your behalf including financial advisers and legal advisers
  • people who hold information about you by virtue of an existing relationship, such as your employer
  • medical professionals (where relevant to KiwiSaver withdrawal applications)
  • the licensed supervisor, the custodian or the administration manager of the Hive KiwiSaver Scheme
  • regulatory and government agencies such as Inland Revenue
  • third party identity verification providers
  • persons who provide us services to enable us to provide you the Website, Portal, Services and Marketing
  • persons to whom a fee or commission may be payable as a result of introducing you to or assisting us to provide Services to you
  • publicly available sources such as social media platforms or public registers
  • marketing consultants, platform providers, event service providers
  • any other person you authorise us to contact.

2.4 We may collect, store and use your Personal Information to: (a) provide the Website, Portal and our Services to you; (b) communicate with you including to: (i) respond to enquiries; (ii) enquire about incomplete or partially complete application or contact me forms; (iii) provide information about your account(s) and market activity; (iv) manage our relationship with you including sending corporate gifts or promotional items; (v) let you know about new Services or improvements to our existing Services; (vi) keep you informed about other opportunities, products and services that we or our business partners offer which may be of interest to you, including marketing materials and targeted marketing using email, phone, social media, website ads or other digital or electronic channels; (c) verify your identity including by undertaking a data match with the issuer of identity documents or other database systems via third party systems; (d) process your requests; (e) understand your preferences and interests; (f) undertake internal quality assurance, quality improvement, research, development and optimisation of our Website, Portal and the Services we provide; (g) meet contractual obligations to attend payment of fees or commissions payable as a result of introducing you to or assisting us to provide Services to you; (h) comply with applicable laws and requirements including but not limited to anti-money laundering and countering of financing of terrorism, financial laws, tax laws; (i) co-operate with any government, industry or regulatory authorities; (j) protect or enforce our legal rights and interests as part of our relationship with you, including defending any claim; (k) conduct statistical analysis, market research and data processing; (l) for any purpose authorised by you, the Privacy Act, GDPR and/or any other applicable law.

2.5 When creating a Hive account or joining Hive KiwiSaver Scheme or first using any of our Services you consent to us sending you marketing materials via electronic message. You can opt to not receive marketing electronic messages any time after creation, joining or first use.

2.6 If we need to use your Personal Information for any purpose not listed above we will contact you to obtain your consent to that purpose.

3. Log Data

3.1 We want to inform you that, whenever you visit our Website or Portal, we may collect information that your browser sends to us that is called Log Data.

3.2 This Log Data may include information such as your computer’s Internet Protocol (IP) address, browser version, pages of our Website or Portal that you visit, the time and date of your visit, the time spent on those pages, links clicked, reports read and other statistics.

4. Cookies

4.1 Cookies are an alphanumeric identifier stored by your browser in order to monitor your use of the Website.

4.2 Our Website uses these “cookies” to collect information and to improve our Services.

4.3 You have the option to either accept or refuse these cookies, and know when a cookie is being sent to your computer. If you choose to refuse our cookies, you may not be able to use some of our Services.

5. Disclosure of Personal Information

5.1 Your Personal Information may be disclosed to, and held and used by, the following persons: (a) any person, whether in New Zealand or elsewhere, whether related to us or not, that provides services or support to or for Hive and where they may require the information for the purposes listed above including persons engaged by us to provide identity verification services, credit checks and marketing services; (b) persons to whom a fee or commission may be payable as a result of introducing you to or assisting us to provide Services to you; (c) people acting on your behalf such as your financial adviser or legal adviser and in limited circumstances medical professionals; (d) if applicable, the licensed supervisor, custodian or administration manager of the Hive KiwiSaver Scheme; (e) any person we need to contact to process your requests; (f) Inland Revenue and where applicable any overseas tax authority; (g) debt collection agencies if you owe us money; (h) law enforcement, government agencies, courts, regulatory bodies, our assignees, our potential assignees and impacted third parties, in New Zealand or elsewhere, where we are required or where we believe disclosure will assist us to comply with law or will assist in the prevention, detection, investigation, remediation of fraud, money laundering or other crimes; (i) any other person or entity where it is relevant to do so for the purposes set out above; (j) anyone to whom you authorise us to disclose your Personal Information or to whom disclosure is permitted under the Privacy Act.

5.2 Following your death we will only release Personal Information to the representative of your estate although limited Personal Information may be released to persons to enable us to determine who the representative of your estate is.

6. Security

6.1 We take the protection of your Personal Information seriously and apply commercially reasonable security measures. However, no internet transmission or electronic storage method is completely secure, and we cannot guarantee absolute security.

6.2 We will take reasonable steps to ensure the Personal Information collected, used or disclosed in accordance with this Privacy Policy is stored in a secure environment protected from unauthorised access, modification or disclosure.

6.3 We will hold Personal Information collected in accordance with this Privacy Policy before and after the provision of the Services in order to fulfil the purposes for which it was collected, but only for so long as we are legally entitled to do so.

6.4 We will advise any User as soon as practicable after becoming aware that a notifiable privacy breach (as that term is defined under the Privacy Act) has occurred in respect of that User, and take all steps necessary to comply with the Privacy Act requirements.

7. Link to Other Sites

7.1 Our Website may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the privacy policy of these websites. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

8. CCTV cameras on our premises

8.1 We may use CCTV cameras on our premises for security and safety purposes. The footage is used to detect and deter criminal behaviour. Usually CCTV footage is retained for 12 months and then deleted.

10. Legal Rights and Access to Personal Information

10.1 We take reasonable steps to ensure the Personal Information we hold is accurate. You must tell us when your Personal Information changes. You may ask to access the Personal Information we hold about you and request correction. We may charge you for this. If we decline making a correction you have the right to ask us to attach a statement of correction to that piece of Personal Information.

10.2 If a User wishes to exercise any of the above rights, please contact Hive at [address]. Please note that we may need evidence to confirm that you are the individual to whom the Personal Information relates. Your email should provide evidence of who you are and set out the details of your request. Hive will process this request as soon as reasonably practicable, provided that we are not otherwise prevented from doing so for legal or other reasons such as, but not limited to: (a) providing such information would have an unreasonable impact on the privacy or affairs of other individuals; (b) providing such information is not reasonably practicable in the manner the User has requested.

11.1 Hive at all times has a person appointed as its privacy officer (the Privacy Officer).
